State Senator Neil Anderson has joined fellow Republican lawmakers in filing a lawsuit in a Sangamon County Circuit Court, calling out Illinois Democrats for what he describes as a deliberate and unconstitutional abuse of power in the passage of Senate Bill 328.
At the heart of the lawsuit is the egregious violation of the Illinois Constitution’s Three Readings Rule, a core safeguard designed to ensure transparency, accountability, and due process in the legislative system. The rule requires that every bill be read by title on three separate days in each chamber. Democrats bypassed this process entirely.
“Democrats in Springfield have grown arrogant in their supermajority power,” said Senator Anderson. “They trample the Constitution, suspend the rules at will, and ram through legislation behind closed doors, with little to no time for review and no public input.”
Senator Anderson emphasized that SB 328 is not just a procedural concern, it’s a dangerous piece of legislation which opens the legal system to greater exploitation by trial lawyers, invites costly litigation, and deals another blow to job creators in a state already struggling with economic instability.
“This is more than politics, it’s a battle for the rule of law,” said Senator Anderson. “If we let this slide, we’re handing the keys of government over to unchecked power. We’re drawing the line. Enough is enough.”
The lawsuit argues that the Democratic majority has developed a pattern of skirting constitutional mandates to fast-track extreme legislation. The result is less transparency, less debate, and fewer protections for Illinois citizens. “We are standing up not only for constitutional order, but for every Illinoisan who deserves an open and honest government,” said Senator Anderson. “This lawsuit is about restoring balance, enforcing the law, and stopping the corrupt games that have plagued this state for far too long.”
